What Kydarin Provides

  • Realistic investor personas with industry-specific questioning patterns
  • Performance analytics, feedback, and improvement recommendations
  • Voice and text-based interaction capabilities
  • Educational and training resources for fundraising preparation

Service Limitations

  • Kydarin is a simulation tool and does not guarantee real-world fundraising success
  • AI responses are generated and may not reflect actual investor opinions
  • Service availability may be subject to maintenance and technical limitations

2. User Conduct and Prohibited Activities

Acceptable Use

  • Use Kydarin solely for legitimate pitch practice and preparation
  • Provide accurate information about your startup and business
  • Respect the intellectual property rights of Kydarin and third parties
  • Maintain the security and confidentiality of your account credentials

Strictly Prohibited Activities

  • Gaming or Manipulation: Attempting to exploit, cheat, or manipulate the AI system to receive inflated scores or feedback
  • Automated Access: Using bots, scripts, or automated tools to access or interact with the platform
  • Data Mining: Attempting to extract, harvest, or scrape AI responses, algorithms, or proprietary data
  • Reverse Engineering: Attempting to reverse engineer, decompile, or discover the source code or algorithms
  • Account Sharing: Sharing account credentials or allowing unauthorized access to your account
  • False Information: Providing deliberately false, misleading, or fraudulent information
  • System Interference: Attempting to disrupt, overload, or interfere with our servers or networks
  • Competitive Intelligence: Using the service to gather intelligence for competing products or services

Enforcement and Consequences

  • We monitor usage patterns and may detect violations using automated systems
  • Violations may result in warning, account suspension, or permanent termination
  • No refunds will be provided for accounts terminated due to violations
  • We reserve the right to pursue legal action for serious violations

3. Account Terms

Account Creation and Security

  • You must provide accurate and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • One account per individual; creating multiple accounts is prohibited
  • You must be at least 18 years old to create an account

Account Responsibilities

  • You are liable for all activities that occur under your account
  • Keep your contact information and payment details up to date
  • Report any technical issues or security concerns promptly

4. Subscription and Billing

Payment Terms

  • Subscription fees are billed in advance on a recurring basis
  • Payment processing is handled securely through Stripe
  • All fees are non-refundable except as required by law
  • You authorize us to charge your payment method for all applicable fees
  • Failed payments may result in service suspension or termination

Cancellation and Refunds

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of your current billing period
  • No partial refunds for unused portions of subscription periods
  • Credits and usage allowances do not roll over between billing periods

5. Intellectual Property

  • All trademarks, logos, and brand elements are our exclusive property
  • AI-generated content and feedback remain our intellectual property
  • We grant you a limited, non-exclusive license to use the service

Your Content

  • You retain ownership of your startup information and pitch content
  • You grant us permission to process your content to provide the service
  • We may use anonymized data patterns to improve our AI models
  • You must have rights to all content you upload or provide

6. Disclaimers and Limitations

Service Disclaimers

  • Kydarin is provided "as is" without warranties of any kind
  • AI responses are simulated and may not reflect real investor opinions
  • We do not guarantee specific outcomes or fundraising success
  • Service availability and performance may vary

Limitation of Liability

  • Our liability is limited to the amount you paid for the service
  • We are not liable for indirect, incidental, or consequential damages
  • You use the service at your own risk and discretion

7. Termination

Termination Rights

  • Either party may terminate this agreement at any time
  • We may terminate accounts for violations of these terms
  • Termination may be immediate for serious violations or security risks
  • Upon termination, your access to the service will cease immediately

8. General Provisions

Legal Terms

  • These terms are governed by the laws of Delaware, United States
  • Any disputes will be resolved through binding arbitration
  • We may update these terms with notice to users
  • If any provision is invalid, the remainder of the terms remain in effect
  • These terms constitute the entire agreement between you and Kydarin

These terms of service are effective as of August 8, 2025 and may be updated from time to time. Continued use of the service after changes constitutes acceptance of the new terms.
